1. Introduction

These Terms of Use ("Terms") govern your access to and use of Waretto, operated by Samarkand Industries OÜ, registered in Estonia under registry code 17492007, with registered address at Narva mnt 5, 10117 Tallinn, Estonia ("Samarkand", "we", "us").

By accessing waretto.com, you agree to be bound by these Terms. If you do not agree, you must not use our services.

Where a separate subscription agreement or enterprise contract applies, those documents take precedence over these Terms to the extent of any conflict.

2. Eligibility

You may use our services only if you are at least 18 years of age, have legal capacity to enter into a binding contract, and are not prohibited from using our services under applicable law.

3. Accounts

You are responsible for maintaining confidentiality of your credentials, providing accurate information at registration, and notifying us immediately of any unauthorised access at security@samarkandindustries.com. You may not share account credentials or use another person's account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable use

You agree not to:

violate applicable law;
infringe intellectual property rights;
transmit malicious code;
attempt unauthorised access to systems;
scrape data beyond API terms;
process data in violation of GDPR;
impersonate any person;
or use our services for fraudulent or harmful purposes.

5. Intellectual property

All content, software, design, data, and trademarks on waretto.com are owned by Samarkand Industries OÜ or its licensors.

You are granted a limited, non-exclusive, non-transferable licence to use our services for their intended purpose. This does not include copying, reproducing, reverse engineering, or creating derivative works.

6. Availability

We aim to maintain high availability but do not guarantee uninterrupted operation. We reserve the right to perform maintenance, modify features with reasonable notice, and suspend access in security incidents.

7. Third-party links and market data

Links to third-party websites do not constitute endorsement. We accept no responsibility for third-party content or availability.

Waretto displays market data, news, and reference information obtained from third-party providers (including CoinGecko, Polygon.io, and similar). Your use of such data is also subject to the terms imposed by the originating provider. We do not warrant the accuracy, completeness, or timeliness of third-party data and accept no liability for delays, omissions, or errors in that data.

8. No investment advice

Important. Waretto is an informational tool. Market data, technical indicators, BUY/SELL signals, backtests, portfolio analytics, and outputs of the Sentinel Alpha Engine or Super Waretto optimiser are provided for informational purposes only. They do not constitute financial, legal, tax, or investment advice, nor a recommendation, solicitation, or offer to buy or sell any security or digital asset. You are solely responsible for your investment decisions. You should consult a qualified professional before acting on any information obtained through Waretto.

9. Limitation of liability

To the maximum extent permitted by law, Samarkand Industries OÜ shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, revenue, trading losses, or data.

Our total aggregate liability for any claim shall not exceed the amount you paid to Samarkand in the 12 months preceding the claim, or €500, whichever is greater.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Disclaimer of warranties

Our services are provided "as is" and "as available". Information provided through Waretto (including market data, analytics, signals, screening results, and compliance checks) is for informational purposes only and does not constitute financial, legal, compliance, or investment advice.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Estonia. Disputes shall be subject to the exclusive jurisdiction of the Harju County Court (Harju Maakohus), Tallinn, Estonia.

If you are a consumer in another EU member state, mandatory consumer protection provisions of your country of residence may also apply.

12. Changes

We will provide at least 30 days' notice of material changes. Continued use after the notice period constitutes acceptance.
